The High Court today turned down an application by ATL-boss Gordon ‘Butch’ Stewart for leave to seek Judicial Review of a decision by the lower court to dismiss the fraud case brought against three former executives of the ATL-pension fund.

High Court Judge, Justice Carol Beswick, this morning dismissed the application seeking to review the ruling handed down by Senior Resident Magistrate Lorna Shelly-Williams.

The High Court Judge indicated that she’ll give written reasons at a later date.

In August, former ATL executives Dr Jeffery Pine, Patrick Lynch and Catherine Barber were freed after a no-case submission was upheld by RM Williams in the Half Way Tree criminal court.

The trio were accused of distributing almost $2-billion to members of the ATL Pension fund without the consent of Mr. Stewart.

RM Williams ruled that the prosecution had not made out a case for which a reasonable jury could have been asked to consider convicting the accused.
